For a representative to file your documents, they need authority from you. The law allows two routes: an appearance apud acta (electronic or in person) or a notarial power of attorney. It cannot be signed on a website, in an app or over WhatsApp.
You grant the authority on the administration's electronic office with your own certificate or Cl@ve. It is entered in the electronic register of powers. No notary and no fee.
You go with your passport to an Oficina de Asistencia en Materia de Registros. An official completes and enters it. No notary and no fee.
You sign it before a notary in Spain or in your own country. A power granted abroad usually needs an apostille and a sworn translation. The Mercurio portal accepts a representative under "Access in representation" only if the link between you and your representative is registered through Apoder@ or with the Consejo General del Notariado, as the portal itself states. Ask the notary how it will be registered.
How to do it and fill in the forms: Forms for exchanging a licence.
Authority entered in the register lasts up to 5 years from registration. You can revoke it at any time in the same way you granted it. Revocation takes effect immediately. A defect in representation can be corrected within 10 days, but it is safer to settle it before filing. The procedure above applies to an applicant who is in Spain. From abroad the application goes through a consulate and representation follows a different regime: confirm it before granting authority.
If you choose Premium, we give you the wording of the scope for your case and check the entry is correct. If not, a written review helps you choose the route.
