Renewals

Missed the renewal window for your residence permit or study stay: what to do

The window to file a renewal opens two months before your permit expires. If it has already expired, the rules allow three more months, but with consequences. We go through the text of the rules.

The window: two months before expiry

For temporary residence (residencia temporal) and for the study stay (estancia por estudios) the window is the same: the application is filed during the two months before the date the permit expires. If you file in that window, the validity of the old permit is extended until the application is decided. Each type says this separately: employed work (art. 80.1 of RD 1155/2024), self-employment (art. 86.1), non-lucrative residence (art. 64.1), family reunification (art. 71.1), exceptional circumstances including arraigo (art. 132.3) and the study stay (art. 55.3 and 55.4).

The general rule is in art. 200.1: permits end when their time runs out, but their validity is extended if the extension, modification or renewal is requested within the established period, until the procedure is decided.

What happens if the permit has already expired

The rules give three months after expiry. If the application is filed in those three months, the validity of the previous permit is also extended until the decision. But filing after expiry counts as an infringement: the same articles add that this is without prejudice to opening a sanctions procedure for the infringement in art. 52.b) of LO 4/2000.

What the infringement is and how big the fine is

Art. 52.b) of LO 4/2000 treats a delay of up to three months in applying for renewal after the permit has expired as a minor infringement. Minor infringements carry a fine of up to 500 euros (art. 55.1.a of LO 4/2000). Whether a procedure will be opened in your case, and the amount, does not follow from the text: the administration decides.

If more than three months have passed

The rules we checked contain no specific provision for filing after the three months, and no express statement that the permit keeps its validity. We do not conclude from this that you can or cannot file: such a case has to be reviewed with the documents. Prepare the expiry date, the dates of any trips out of Spain, and whatever proves your residence in that period.

What to do now

Find the expiry date on your TIE card or in the decision that granted the permit. If less than two months remain, you are already in the window: file. If less than three months have passed since expiry, file before they end. The table of all permit types and their deadlines is on the page Renewing residence and study permits.

Frequently asked questions

Can I work while a renewal filed after expiry is processed?

The articles we checked say only that the validity of the previous permit is extended until the decision (art. 80.1, 86.1). The extent of your rights in that period is not detailed there, so check it against your type of permit.

Will there definitely be a fine?

The rules classify the delay as a minor infringement and allow a sanctions procedure (art. 52.b LO 4/2000) with a fine of up to 500 EUR (art. 55.1.a). Those articles do not present it as automatic: the procedure may or may not be opened.

Do the same deadlines apply to the study stay?

Yes: art. 55.3 and 55.4 of RD 1155/2024 repeat the two months before and three months after.

What about extending an arraigo permit?

Art. 132.3 has the same two and three months.
